The Truth About "Debt Settlement "Programs: Why They Make Things Worse

If you are drowning in credit card bills, medical debt, or personal loans, you have probably heard the radio ads or received the mailers: "Settle your debt for pennies on the dollar! Avoid bankruptcy! New government relief program! Call our debt relief program today!"

When you are stressed about money, these promises sound like a real lifeline. Desperation makes you want to believe that it's true. Unfortunately, for most Illinois consumers, these debt settlement and "debt relief" companies are nothing more than predatory scams. They will take your money, further destroy your credit, and leave you significantly worse off than when you started.

Here is the truth about how these companies operate, why the Federal Trade Commission (FTC) constantly warns consumers about them, and why a legal, federal court ordered bankruptcy discharge is almost always the best option for your wallet, your credit, and your life.

How the Debt Settlement Scam Works When you sign up for a debt settlement program, the company typically requires you to do three things:
  1. Stop paying your credit cards and lenders immediately.
  2. Start making a monthly payment directly into a "special savings account" controlled by the debt settlement company.
  3. Sign paperwork that redirects all of your creditor mail and phone calls to the debt settlement company instead of to you.

They promise that once enough money builds up in that account, they will negotiate with your creditors. But here is what actually happens behind the scenes:
  • The "Silent" Trap: Because you signed paperwork redirecting your mail and calls, your phone stops ringing and the scary letters stop coming. You feel a massive sense of relief and think, "Wow, the program is working!" But this is a trick. By cutting you off from your creditors, the settlement company hides the truth: your debt is spiraling out of control. You can no longer see the massive late fees adding up or the lawsuit warnings being sent.
  • Your Debt Grows, Not Shrinks: Because you stopped making payments, your creditors hit you with late fees and aggressive penalty interest rates. A $10,000 balance will quickly balloon to more than $15,000-$20,000.
  • Your Credit is Destroyed: Every missed payment is reported to the credit bureaus every single month. Your credit score will tank and continue to go down month by month.
  • You Get Sued: Creditors are under no legal obligation to negotiate with a debt settlement company. There are no government programs that require this. Instead of making a deal, many creditors will simply file a lawsuit against you in Cook County or the collar county courts. This can quickly lead to wage garnishment and frozen and seized bank accounts.
  • Hidden Fees Drain Your Money: While you are getting sued, the debt settlement company is quietly and quickly draining the money you pay them every month through "maintenance fees" and "administrative costs." By the time you realize the program is a scam, your money is all gone.

The Better Alternative: A Court-Ordered Bankruptcy Discharge. Unlike sketchy debt settlement call centers, bankruptcy is a formal, federal law, court-supervised legal process designed to give honest people a true fresh start. The irony is that debt settlement companies lead you to believe that there is some special government program for debt settlement. There is not. The real government program is federal bankruptcy law, which has been around for over 200 years.

  • The Automatic Stay: The moment you file bankruptcy, federal law prohibits creditors from calling you, suing you, garnishing your wages, or freezing your accounts. Debt settlement companies cannot offer this protection.
