Illinois Bankruptcy Exemptions How the New $50,000 Homestead Exemption Protects Your Home

What Changed with the Illinois Homestead Exemption? For decades, the Illinois homestead exemption was frozen at just $15,000. This meant that if you filed for Chapter 7 bankruptcy, you could only protect $15,000 of your home's equity. Now, under the new 2026 law, the homestead exemption has more than tripled:

  • Single Homeowners: You can now protect up to $50,000 of equity in your primary residence.
  • Married Couples (Filing Jointly): You can now protect up to $100,000 of equity in your jointly-owned home.

The court allows you to establish a 3-to-5-year repayment plan to catch up on missed payments, and the new 2026 limits ensure your hard-earned equity remains legally shielded from other creditors during the process.
