Wells Fargo Bank is sending letters to consumers against who it previously completed foreclosures. Most of the foreclosures were completed under the name "America's Servicing Company," which was an alter ego of Wells Fargo at the time. The letters inform the consumers that the foreclosure was in error! That it was in error because the homeowner qualified for a HAMP modification at the time. However, due to a "glitch" or "calculation error," Wells Fargo denied the modification. The letter comes with a check for thousands of dollars and an offer that Wells Fargo will enter mediation.
Consumers who receive these letters should NOT contact Wells Fargo directly. Wells Fargo should NOT be trusted. They are looking to get out of the mess they created for as cheap as possible. If you get one of these letters, you should note that it is not a scam. It is unfortunately real. You should contact a Consumer Rights attorney as soon as possible. The attorneys at Robson & Lopez LLC have handled these cases and are one of the few law firms to take Wells Fargo to trial for these exact actions.
